1. Acceptance of Terms

By accessing and using RhombergIT ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms and Conditions, please do not use our Service.

2. Description of Service

RhombergIT provides a web-based interface for managing Kubernetes backups through Velero. The Service allows users to monitor, manage, and optimize their backup infrastructure.

3. Account Registration

To use our Service, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account

4. Payment Terms

The Service is provided at an annual subscription fee of $99 USD. By subscribing, you agree to the following:

  • Payment is due annually in advance
  • Prices are listed in USD; other currencies are converted at checkout
  • All fees are non-refundable except as required by law
  • You authorize us to charge your payment method on a recurring annual basis
  • We reserve the right to change pricing with 30 days notice

5. Cancellation and Termination

You may cancel your subscription at any time. Upon cancellation:

  • Your access will continue until the end of your current billing period
  • No refunds will be provided for partial years
  • Your data will be deleted 30 days after cancellation

We reserve the right to suspend or terminate your account if you violate these terms.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to transmit malware or malicious code
  • Share your account credentials with others

7. Data and Privacy

We collect and process data as described in our Privacy Policy. By using the Service, you consent to such processing. We do not store your backup data, only metadata and connection information required to provide the Service.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by RhombergIT and is protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service.

9. Service Availability

While we strive for 99.9% uptime, we do not guarantee that the Service will be available at all times. We reserve the right to modify or discontinue the Service with reasonable notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RHOMBERGIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the event giving rise to liability.

11. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Indemnification

You agree to indemnify and hold harmless RhombergIT and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RhombergIT operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.
